Real estate contract is an important document that we sign while buying or selling a house. Not many of us know what exactly goes into this contract. One must understand this contract before buying or selling. Now what’s a contract actually? A real estate contract is a contract for the purchase or exchange of land and property between parties. The contract can cover a purchase, sale, lease, or rental. It can be between two or more parties and is typically in writing. The real estate contract follows normal contract law and legal requirements, and is sometimes known as a land contracts or as a contract for deed. In real estate we use the terms acceptance and offer and then there is counteroffer.

Acceptance and Offer

In this type of contract the buyer signs and makes the contract effective. This contract is not valid as long as the seller does not accept the terms and conditions of the agreement. And if the seller totally refuses to the conditions of the agreement then there can be no contract. This contract if valid only when the seller agrees to the terms set by the buyer.


Counteroffer

Sometimes the seller may agree to some conditions of the buyer but not all. At this point both the parties can negotiate. The seller could negotiate with the buyer to change the terms and condition set by the buyer. If this happens then the offer made by the seller to the buyer is called the counteroffer. If the buyer agrees to the counteroffer made by the seller then their mutual agreement results in the contract and if the buyer refuses to agree to the counteroffer made by the seller then there can be no contract between them.

These terms should be very clear before the two parties involve in a contract for a successful deal.
